Terms & Conditions

Welcome to Blue berry. By using our services, you agree to be bound by the following terms and conditions:

 

1. Scope of Work

  • The company defines the agreed scope of work according to the contract or the technical and financial proposal provided to the client.

  • Any additional services outside the agreed scope will be priced separately.

 

2. Intellectual Property

  • Ownership of the source code, designs, and final deliverables shall be transferred to the client after full payment, unless otherwise stated in the contract.

  • The company reserves the right to showcase the work in its portfolio for marketing purposes unless the client requests otherwise in writing.

 

3. Payment Terms

  • Payments are made according to the schedule defined in the contract (down payment + milestone payments + final payment).

  • In case of payment delays, the company has the right to suspend work until dues are settled.

 

4. Timeline

  • Delivery dates are determined according to an agreed project schedule.

  • Delays caused by the client’s failure to provide required information or approvals will not be the company’s responsibility.

 

5. Support & Maintenance

  • The company provides free technical support for  3 months after the final delivery.

  • After the support period ends, the client may subscribe to an annual or monthly maintenance contract.

 

6. Confidentiality

  • The company is committed to maintaining the confidentiality of the client’s data and will not share it with any third party without written consent.

 

7. Limitation of Liability

  • The company shall not be held liable for any direct or indirect damages resulting from the use of the product after delivery, except in cases of defects caused by the company’s negligence.

 

8. Revisions

  • The project includes a predefined number of revisions agreed upon in advance.

  • Any additional revisions will be charged separately.

 

9. Termination

  • Either party has the right to terminate the contract if the other party fails to fulfill its obligations, after providing written notice of 10 days.

 

10. Governing Law

  • These terms are governed by the laws of the Kingdom of Saudi Arabia, and any disputes shall be resolved before the competent courts in Jeddah.
